Les précisions de Me Vencadasamy
Cette semaine a été marquée par l?injonction que le Cercle des Nageurs de Quatre-Bornes (CNQB) a entrée en Cour vendredi dernier contre la Fédération mauricienne de natation (FMN).
Me Nylen Vencadasamy, qui représentait les intérêts du club, a tenu à préciser que la partie plaignante a décidé de « retirer »
l?injonction au vu de certaines garanties obtenues et qu?elle ne fut donc pas « rejetée », comme mentionné dans notre édition de jeudi.
« L?objectif derrière la demande d?injonction était de s?assurer que les nageurs du CNQB, éligibles de prendre part aux Jeux de l?ACNOA, ne soient pas pénalisés », explique-t-il. « L?affaire a été entendue une première fois le vendredi 1er décembre devant le juge Caunhye qui a émis une injonction intérimaire empêchant la FMN d?exclure les nageurs de la sélection. Cette action du CNQB était devenue nécessaire à la suite d?une lettre ambiguë reçue de la fédération et le club ne voulait pas que ses droits soient lésés. Lorsque Me Gavin Glover, qui représentait la FMN, a déclaré, mardi, devant le juge Domah que les noms des nageurs du CNQB figuraient sur la liste communiquée aux organisateurs des Jeux de l?ACNOA, nous avons alors retiré l?injonction », fait-il encore ressortir.

ORDER
Mr D. Vencadasamy, of Counsel, appears together with Mr A. Gopee, of Counsel, for the applicant instructed by Mr Attorney S. Mardemootoo and puts in the usher?s return.
Mr G. Glover, of Counsel, appears for the respondents instructed by
Mr Attorney D. Luchmun and states the following :-
(a) in relation to the 1st prayer regarding the ACNOA games, the respondents state that all the applicant?s eligible swimmers are on the list of participants which list has been communicated to the organizers as far back as 29 November 2006; and
(b) as regards the two other prayers regarding the competitions of 2 & 3 December 2006, the respondents state that all the participant?s eligible swimmers did participate in those competitions.
Mr Glover further states that, in the light of the above statement and in the light of the undertaking of the applicant as to damages, the respondents expressly reserve their rights to claim the damages and they move that the present application be set aside with costs against the applicant.
Mr Vencadasamy confirms the participation of the applicant?s eligible swimmers in the competitions of 2 & 3 December 2006 and also takes note of the above statement. He moves to withdraw the application.
Mr Glover has no objection and moves for costs.
Upon hearing parties, I set aside the application with costs.
