Dans son point de presse après sa rencontre avec les victimes de vente à la barre de mercredi, diffusé in toto dans le journal télévisé de la soirée, le Premier ministre a déclaré qu?il s?étonnait que rien n?ait été fait après la publication du rapport Glover en 2004 qu?on a laissé dormir dans un tiroir. Ce rapport a été rendu public en décembre 2004. L?Assemblée nationale ajournée en mars 2005 devait être dissoute le mois suivant. Les élections générales ont eu lieu en juillet 2005. Ces extraits des délibérations des réunions du Conseil des ministres parlent d?eux-mêmes et mettent en relief le procédé fallacieux utilisé par Navin Ramgoolam et la propre inaction de son gouvernement.

2. Cabinet has taken note of the recommendations of the Report of the Commission of Inquiry on Sale by Levy chaired by Sir V. Glover K.T. G.O.S.K., former Chief Justice, and has agreed to release the report and to invite the public to submit their comments thereon.

Cabinet has agreed to the implementation of the recommmendations contained in the Report of the Commission of Inquiry on Sale by Levy and has taken note that the issues raised in the preliminary findings in the ?Liverpool case? judgement have been taken care of by the amendments brought to the Moneylenders Act 2002.

3. Cabinet Decisions taken on 23 December 2004:

Cabinet has taken note of representations made by the Mauritius Bankers Association Ltd (MBA) in a letter dated 21 December 2004 addressed to the Prime Minister on the recommendations of the Report of the Commission of Inquiry on Sale by Levy and has agreed to the setting up of an Implementation Committee chaired by the Secretary to Cabinet ... to oversee the implementation of the recommendations. The Committee will also consider the comments made by the MBA. Further the Prime Minister will meet representatives of the victims of Sale by Levy on Monday 27 December 2004.

Cabinet has agreed to the draft Credit Facilities Bill which makes provision for the implementation of the recommendations of the Commission of Inquiry on sale by Levy being disseminated prior to its introduction into the National Assembly with a view to enabling stakeholders to take cognizance thereof and make comments. The draft Bill makes provision inter alia for the setting up of a Commission on Indebtedness for the purpose of overviewing and, where appropriate, regulating the drawing up and implementation of contracts for the grant of credit facilities and for a change in the judicial process for the sale of property given as security to guarantee the repayment of a credit facility in case of default from a system of public adjudication by auction to a Court controlled system of sealed offers to purchase. The cases of victims identified by the Commissions of Inquiry on Sale by Levy would be examined on a case to case basis and appropriate action taken accordingly.

Cabinet has agreed to the Credit Facilities Bill which makes provision for the implementation of the recommendations of the Commission of Inquiry on Sale by Levy being disseminated prior to its introduction into the National Assembly with a view to enabling stakeholders to take cognizance thereof and make comments. The draft Bill is available on the website of the Ministry of Finance.
