● Why has Iqbal Ghani been arrested?

He has been arrested under a charge of threatening to commit an act of terrorism. He seized the opportunity of an illegal protest on Monday 9th April to say, ?PM, if you do not amend the Constitution, if you do not let us use loudspeakers for Azaan, we are very sad but there will be blood in front of Parliament.? He was thus arrested under the Prevention of Terrorism Act (PoTA) but, since then, there has been a debate as to whether it was the right issue?

● What arguments have those who think Pota does not apply in that case?

While the suspect?s lawyer wonders the charge is ?exaggerated?, MMM leader, Bérenger, thinks it would have been more appropriate to arrest the suspect under the Public Gathering Act. Opposition leader, Bodha, wonders whether the PM has information that the security of the country is at stake.

● So, the provisional charge of Iqbal Ghani will not be changed?

The police has asked for the DPP?s advice to know if the Pota is relevant in that case. If the DPP finds it is not justified, then the provisional charge may be changed accordingly. But if the DPP finds the police decision right, then it will be up to the court to see if the accusation ?holds water?. If the court is not convinced, the case will be struck off.
